Terms of Service.
What you get, what you pay, what is promised and what is not. A one-time build fee, a month-to-month care plan, and you own everything you came in with. Plain English on purpose.

Welcome. These terms cover what you get when you sign up for a website and AI service from Bally Does AI, what you pay, what we promise (and what we don't), and how we handle the boring-but-important legal stuff. They're written in plain English on purpose. If a section is unclear, text or call (519) 761-2251 and Hunter will walk you through it.
By paying your first invoice, you agree to these terms. If you don't agree, don't pay the invoice and we'll part on good terms.
Who You're Doing Business With
Bally Does AI is operated by Hunter Ballantyne, a sole operator based in Ontario, Canada. There is no team, no offshore call centre, no junior account manager who'll inherit your file. You are dealing directly with the person who builds and maintains your website.

What You're Buying
Bally Does AI builds and runs a small business website paired with an AI assistant that helps you handle leads. A typical setup includes:
- A custom-built website on a domain you own (or one we help you register in your name)
- On the Pro and Premium builds, an AI front desk that answers web chat, email and SMS in writing, using prices and hours you supply. It does not answer phone calls and there is no synthetic voice.
- Hosting, an SSL certificate, basic SEO setup, and a contact form connected to your email
- Monthly maintenance: content edits, uptime monitoring, software updates, and minor design tweaks
- Optional SMS reply automation through Twilio so leads get a fast text back
There are three build sizes, all priced in Canadian dollars. The build fee is charged once; the care plan is monthly.
- Basic, the presence site: $800 CAD to build, then $70 CAD per month. Single page. No AI front desk and no booking form at this size.
- Pro, the working site: $2,000 CAD to build, then $90 CAD per month. Up to eight pages, the AI front desk, and a booking or quote flow.
- Premium, the showcase site: $2,500 CAD to build, then $90 CAD per month. Everything in Pro plus the full showcase build and the launch kit.
Where an owner cannot pay the build fee up front, a monthly alternative is available on the Pro and Premium sizes only: $300 activation plus $330 per month for Pro, or $500 activation plus $400 per month for Premium, on a twelve-month minimum. This is the one arrangement here with a minimum term, and it is stated before you sign.
The build fee covers design, content writing, the build itself, AI training on your business where the size includes it, and launching everything live. The build fee is payable in full before work begins. The care plan covers hosting, the SSL certificate, the domain, maintenance, AI usage costs, and the changes you ask for after launch.
What's not included by default: paid ad spend, third-party software your business already uses, custom integrations with niche systems, large redesigns, or e-commerce stores. If you want any of those, we'll quote them separately before doing the work.
Payment
The care plan is billed through Stripe on the same date each month, starting the day your site goes live. The build fee is invoiced before work begins and must be settled before work starts.
All prices are in Canadian dollars. Right now this is a small supplier under the Excise Tax Act and HST is not charged, so the price you see is the price you pay. If we become HST-registered, HST will be added to your invoice as required by law, and we'll tell you before that happens.
If a payment fails, we'll email you and try again over the next few days. If a payment is more than 14 days late, we may pause the AI assistant or temporarily take the site offline until the balance is settled. We'll always reach out before doing that. There are no late fees or interest charges. We just want to talk to you.
Stopping the care plan
The care plan runs month to month with thirty days notice and no cancellation fee. The build fee is separate: it buys the site outright and is not refundable once the build has started. Stopping the care plan does not take the site away from you, and the domain was registered in your name from day one. The one exception is the monthly alternative described above, which carries a twelve-month minimum.
To stop the care plan, text or email (519) 761-2251 or hunter.ballantyne@ballydoesai.com. You will get a written reply confirming it and the date the plan ends. Either channel counts as notice; email simply gives you the cleaner paper trail.
Your service runs through the end of the billing period you've already paid for. We don't pro-rate refunds for mid-month cancellations, but you keep using everything until the period ends.
What Is and Is Not Promised
There is no money-back guarantee, no launch-date guarantee, and no results guarantee. That is deliberate, and it is stated here rather than buried. What you get instead is a private preview link before anything goes public, and an unlimited back and forth to get the build right as part of the build fee, so you see exactly what you are getting before it goes live.
Once the build has started the work has been done, so the build fee is not refundable. The care plan stops on thirty days notice at any time and the site, the copy and the domain remain yours.
Ownership: What's Yours, What's Ours
This is important, so it gets its own section.
Yours:
- Your domain name. We register it in your name (or transfer it into your name if we use a domain you already own). You can move it to any registrar at any time.
- Your content. The text, photos, logo, and brand assets on the site belong to you, including anything we write or edit for you. Once you've paid the setup invoice, all custom-written copy is yours, royalty-free, forever.
- Your customer data. Every email address, phone number, name, and chat transcript captured through your site belongs to you. We'll hand it over in a standard format (CSV or JSON) whenever you ask, including the day you cancel.
- Your Google Business Profile, social accounts, and any third-party tools registered under your business. Those stay yours regardless.
Ours:
- The underlying templates, code patterns, AI prompt structures, and tooling we use across multiple clients. You're licensed to use them as part of your live site for as long as you're a subscriber. If you cancel, we'll either transfer a static export of your site to a host of your choice (free of charge in the first 90 days) or take it offline. We don't license the back-end tooling itself for you to run independently.
- The "Bally Does AI" name, logo, and any case studies or screenshots we make from your site (we'll ask permission before using any specific brand or imagery publicly).
If anything is ever unclear about who owns what, the rule we use is: if it identifies your business or your customers, it's yours.
How We Handle Your Data and Your Customers' Data
We're a Canadian business and we follow the Personal Information Protection and Electronic Documents Act (PIPEDA). That means we only collect the information needed to run your site, we keep it secure, and we don't sell it.
Where data physically lives:
- Website hosting runs on Vercel (US-based with Canadian edge nodes)
- Customer database runs on Supabase in a Canadian region
- Form submissions are processed by Netlify Forms
- Payments are processed by Stripe
- SMS messages are sent and received through Twilio
- AI responses are generated by OpenAI and Anthropic, both US-based providers
Because some processing crosses the border, your customers' information may be handled in the United States. We disclose this in the privacy policy on your site (we write that for you), and we use providers with industry-standard security and PIPEDA-compatible data handling.
Quebec residents: If your business is based in Quebec or you have Quebec customers, Quebec's Law 25 applies on top of PIPEDA. We can configure the consent banners and disclosures needed to keep you compliant. Just let us know.
CASL (anti-spam): Any marketing emails or texts we send on your behalf will include your business name, a working unsubscribe link, and clear consent records. If you ask us to send something that doesn't meet CASL standards, we'll push back and suggest how to fix it.
What We Promise (and Don't)
We do our best to keep your site online, your AI assistant answering correctly, and your data safe. That said, here's the honest version:
- The service is provided "as is." We don't promise it will be uninterrupted, error-free, or perfectly suited to every business situation.
- We don't guarantee any specific number of leads, sales, search ranking, or revenue. Marketing results depend on many factors we don't control: your local market, your pricing, how fast you respond, the season, the weather, your competitors.
- Third-party services (Vercel, Supabase, Stripe, Twilio, OpenAI, Anthropic) sometimes have outages. When they do, parts of your service may be temporarily unavailable. We monitor and respond quickly, but we can't promise zero downtime.
- The AI assistant is a helpful first responder, not a replacement for your judgment. It can get things wrong. We tune it carefully and you review the conversations, but you're responsible for the commitments your business ultimately makes to customers.
Limitation of Liability
To the maximum extent allowed under Ontario law, Bally Does AI's total liability for anything related to these terms, whether for a missed lead, downtime, lost revenue, a data issue, a bug, or anything else, is capped at the total amount you've paid us in the 12 months before the issue.
We're not liable for indirect or consequential losses (lost profits, lost opportunities, lost goodwill). This cap is part of the bargain that lets us offer the service at the price we do. If your business genuinely needs unlimited-liability coverage, you'll want a much larger agency with a much larger price tag.
Nothing in these terms limits any rights you have under Ontario consumer protection law, the Sale of Goods Act, or any other law that can't be contractually limited.
Governing Law
These terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any legal action must be brought in the courts of Ontario.
Disputes
If something goes wrong, the first step is always to text or call (519) 761-2251 or email hunter.ballantyne@ballydoesai.com. Most issues get sorted out in a single conversation.
If we can't reach a resolution that way, both parties agree to try mediation through a mutually-agreed Ontario-based mediator before starting any court action. Mediation costs are split 50/50.
If mediation doesn't resolve things, the dispute can be brought in the Ontario Small Claims Court (for amounts up to its jurisdictional limit) or the Ontario Superior Court of Justice.
You agree not to participate in any class action against Bally Does AI; disputes are handled one-on-one. This doesn't apply where class-action waivers aren't enforceable under Ontario law.
Changes to These Terms
We may update these terms occasionally, for example, if we add a new feature, change a price, or have to adjust to a new privacy law. When that happens:
- We'll email you at least 30 days before the change takes effect.
- The "Last updated" date at the top of this page will change.
- If you don't agree with the new terms, you can cancel during that 30-day window and get a pro-rated refund for any month you've already paid for but won't use.
Continuing to use the service after the effective date means you accept the updated terms.
Acceptable Use
Don't use your site or AI assistant to do anything illegal, send spam, infringe on someone else's intellectual property, or publish content that's defamatory, hateful, or harmful. If we get a credible complaint along those lines, we'll reach out first. If the issue isn't fixed, we may suspend or end the service. Refunds in those cases are at our discretion.
Entire Agreement
These terms, plus the privacy policy on your website and any written quote or invoice you've accepted, make up the full agreement between you and Bally Does AI. Verbal promises, marketing materials, or chat messages don't override what's written here. If any part of these terms is found unenforceable, the rest still applies.
